1. Acceptance of Terms
By accessing or using the GXGFX Trading trading platform, website, or any related services (collectively, the 'Platform'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and GXGFX Trading.
2. Eligibility
To use our Platform, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Not be a resident of restricted countries (see Section 16)
- Not be on any sanctions lists or prohibited persons lists
- Provide accurate and complete registration information
- Maintain the security of your account credentials
3. Account Registration
3.1 Account Creation
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
3.3 Verification
We may require identity verification (KYC) documents as part of our regulatory obligations. Failure to provide required documents may result in account restrictions or closure.
3.4 Multiple Accounts
You may not maintain multiple accounts without our prior written consent. We reserve the right to merge or close duplicate accounts.
4. Trading Terms and Conditions
4.1 Trading Authorization
When you place orders through our Platform, you authorize us to execute trades on your behalf in accordance with your instructions. All trades are final and non-reversible once executed.
4.2 Market Orders
Market orders are executed at the next available market price. Due to market volatility, the executed price may differ from the quoted price at the time of order placement.
4.3 Limit Orders
Limit orders are executed at the specified price or better. We do not guarantee execution of limit orders, especially during fast market conditions.
4.4 Leverage and Margin
Trading with leverage involves high risk. You must maintain minimum margin requirements. We reserve the right to close positions if margin falls below required levels.
4.5 Trading Hours
Trading hours vary by instrument. Forex: 24/5 (Sunday 5pm EST to Friday 5pm EST). Cryptocurrencies: 24/7. Indices and commodities follow exchange hours.
5. Fees and Charges
You agree to pay all fees and charges associated with your account as specified on our website or in your account agreement. These may include:
- Spreads and commissions on trades
- Overnight financing (swap) fees
- Inactivity fees after 6 months
- Withdrawal fees (one free withdrawal per month)
- Currency conversion fees
- Account closure fees
All fees are subject to change with 30 days notice. You are responsible for any taxes applicable to your trading activities.
6. Deposits and Withdrawals
6.1 Deposits
Funds must be deposited from accounts in your name. Third-party deposits are prohibited and will be returned. Processing times vary by method: credit cards (instant), bank wire (1-3 business days), crypto (10-30 minutes).
6.2 Withdrawals
Withdrawal requests are processed within 24 hours on business days. Funds are returned to the original funding source where possible. Minimum withdrawal: $50. Maximum withdrawal: No limit, subject to verification.
6.3 Anti-Money Laundering
We comply with AML regulations and may require additional documentation for large withdrawals or suspicious transactions. Withdrawals may be delayed for compliance review.
7. Risk Disclosure
Trading financial instruments carries significant risk. You acknowledge and agree that:
- You may lose all of your invested capital
- Past performance does not guarantee future results
- Leverage can amplify both profits and losses
- Market conditions can change rapidly
- You are solely responsible for your trading decisions
- We do not provide investment advice
- You should only trade with risk capital
- Consider seeking independent financial advice
8. Prohibited Activities
You may not engage in any of the following activities:
- Market manipulation or abusive trading practices
- Arbitrage abuse or latency arbitrage
- Hedging between accounts
- Using automated trading systems without authorization
- Money laundering or terrorist financing
- Fraudulent or illegal activities
- Attempting to bypass security measures
- Copyright or intellectual property infringement
- Spamming or harassment
- Reverse engineering our platform
9. Platform Use and Limitations
9.1 License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal trading purposes.
9.2 Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may suspend access for maintenance, updates, or emergencies with or without notice.
9.3 Third-Party Services
Our Platform may integrate with third-party services. We are not responsible for the availability, accuracy, or security of such services.
10. Intellectual Property Rights
All content on the Platform, including trademarks, logos, software, text, graphics, and APIs, is our property or our licensors'. You may not copy, modify, distribute, sell, or lease any part of our Platform without our express written consent.
11. Privacy and Data Protection
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
12. Account Termination
12.1 Termination by You
You may close your account at any time by contacting support. Any open positions must be closed before account closure.
12.2 Termination by Us
We may suspend or terminate your account at any time for: violation of these Terms, suspicious activity, regulatory requirements, or at our discretion with 30 days notice.
12.3 Effect of Termination
Upon termination, you remain liable for all obligations, including fees and taxes. We may retain your information as required by law.
13. Limitation of Liability
To the maximum extent permitted by law, GXGFX Trading and its affiliates shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of profits, trading opportunities, or data
- Damages from market volatility or system delays
- Third-party claims against you
- Acts of God, war, terrorism, or regulatory changes
Our total liability shall not exceed the fees paid by you in the 6 months preceding the claim.
14. Indemnification
You agree to indemnify and hold GXGFX Trading harmless from any claims, damages, losses, liabilities, and expenses arising from: your use of the Platform, violation of these Terms, infringement of third-party rights, or violation of applicable laws.
15. Governing Law
These Terms shall be governed by the laws of the British Virgin Islands, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the courts of the British Virgin Islands.
16. Restricted Countries
Due to regulatory restrictions, we cannot accept clients from the following jurisdictions:
- United States of America
- North Korea
- Iran
- Syria
- Sudan
- Crimea Region
- Cuba
- Any other jurisdiction where our services are prohibited by law
17. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network failures, power outages, or strikes.
18. Amendments
We may modify these Terms at any time. Material changes will be notified via email or platform notice 30 days before effective date. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Platform before the effective date.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and GXGFX Trading regarding your use of the Platform.
